RESUMO

O presente trabalho de conclusão de curso faz uma análise da aplicação do princípio do contraditório no inquérito policial, à luz de um sistema puramente acusatório. Aborda os principais sistemas processuais presentes no processo penal, em especial os sistemas que vigeram no Brasil, relatando a sua evolução histórica. Analisa os conflitos doutrinários e jurisprudenciais sobre o presente tema. Faz uma breve análise da Constituição Federal de 1988, do Código de Processo Penal de 1941 e do Estatuto do Advogado. Nessa perspectiva, analisa em que medida o contraditório em sede de inquérito policial, no processo penal brasileiro, pode contribuir para a consolidação de um modelo de processo típico de um sistema acusatório. Por fim, quanto ao método de pesquisa, esta será hipotético dedutivo, a qual utiliza no seu delineamento a coleta de dados em fontes bibliográficas disponíveis em meios físicos e na rede de computadores, com o objetivo de construir uma reflexão crítica sobre o presente tema.

ABSTRACT

The present course conclusion paper analyzes the application of the adversarial principle in the police investigation in the light of a purely accusatory system. It addresses the main procedurais systems present in criminal proceedings, especially the systems that have been in place in Brazil, reporting their historical evolution. It analyzes the doctrinal and jurisprudential conflicts on this subject. It makes a brief analysis of the Federal Constitution of 1988, the Code of Criminal Procedure of 1941 and the Statute of the Lawyer. From this perspective, it analyzes the extent to which the contradictory in the context of a police investigation in the Brazilian criminal proceedings can contribute to the consolidation of a typical process model of an accusatory system. Finally, regarding the research method, this will be hypothetical deductive, which uses in its design the collection of data in bibliographic sources available in physical media and in the computer network, with the objective of constructing a critical reflection on the present theme.
