INCLUSIVE EDUCATION AND THE (IN) CONSTITUTIONALITY OF DECREE 10.502/2020: PERSPECTIVES IN THE FIELD OF PERSONS WITH DISABILITIES

RESUMO
A Educação especial é uma modalidade integrante da educação inclusiva, cujo intuito primordial é o oferecimento de educação de qualidade a todos, sem diferença. A partir dessa afirmação, foi objetivo dessa pesquisa analisar o decreto de Lei 10.502/2020 e refletir acerca de seu impacto no processo de inclusão de pessoas com deficiência no âmbito educacional. Como objetivos específicos definiu-se: compreender os marcos históricos e legais do processo de inclusão da pessoa com deficiência na educação brasileira, discutir a inconstitucionalidade do decreto analisado à luz da LBI e analisar o significado da aprovação do decreto em termos de retrocesso ao processo de inclusão. A metodologia utilizada foi a pesquisa bibliográfica e a análise documental, ao passo que se recorreu a livros, artigos científicos e pesquisas publicados sobre a temática, bem como, ao estudo da referida legislação que, no mesmo ano de sua publicação foi suspensa. A título de conclusão, por ferir os princípios de igualdade e equidade, o referido Decreto é inconstitucional e apresenta em seu texto ações retrocessivas que representam um retorno a tempos pregressos em que as pessoas com deficiência eram simplesmente excluídas da sociedade por não serem vistos como úteis ao seu funcionamento.

ABSTRACT
Special Education is an integral modality of inclusive education, whose primary purpose is to offer quality education to all, without difference. Based on this statement, the objective of this research was to analyze the Decree of Law 10.502/2020 and reflect on its impact on the process of inclusion of people with disabilities in the educational field. The following specific objectives were defined: to understand the historical and legais frameworks of the process of inclusion of people with disabilities in Brazilian education, to discuss the unconstitutionality of the decree analyzed in the light of the LBI and to analyze the meaning of the approval of the decree in terms of retrogression to the process of inclusion. The methodology used was bibliographic research and document analysis, while books, scientific articles and published research on the subject were used, as well as the study of the legislation that, in the same year of its publication, was suspended. In conclusion, as it violates the principles of equality and equity, the Decree is unconstitutional and presents in its text retrogressive actions that represent a return to previous times in which people with disabilities were simply excluded from society for not being seen as useful. to its operation.
