ABSTRACT
Criminal policies have evolved over time, aiming for better and more efficient protection of legally and criminally protected interests. In this context, it is only through an understanding of the criminal phenomenon that effective public policies can be established to prevent both the occurrence and recurrence of behaviors that threaten the most cherished legal interests of society. Therefore, it is necessary to examine the main instruments of public policy, which, as previously mentioned, have evolved in accordance with social and cultural transformations. In this regard, we must inquire whether the primary tools of criminal policy are sufficient and effective in fulfilling their intended mission.
