Cooperative Federalism in the COVID-19 Pandemic: an analysis of the Brazilian Supreme Court’s Jurisprudence

ABSTRACT: The Federal Constitution of 1988 established a series of legislative and material competencies for states and municipalities, embodying the so-called Cooperative Federalism. However, the jurisprudence of the Supreme Court has historically adopted a stance favoring centralized interpretations in the figure of the Federal Union. With the advent of the Covid-19 pandemic, the Court’s position seems to have shifted in favor of smaller entities. This article aims to analyze the rulings issued during the pandemic period to understand if there is a trend towards a shift in the Court’s position.
