DATING CONTRACT AND STABLE MARRIAGE LEGAL ASPECTS REGARDING ITS RECOGNITION AND VALIDITY.

INTRODUCTION

In this article, the validity of the dating contract in relation to the stable union is discussed, as well as its consequences in the legal sphere, inquiring, for this discussion, legal splendor in Civil Contract Law and Family Law. The aim of the research is to elucidate what a dating contract is, pointing out its aspects and traits and its validity. Firstly, the work is analyzed from a conceptual point of view, as well as the historical evolution of the definition of dating, according to the classification of the Brazilian legal framework. In a second step, in order to differentiate dating from a stable union, the elements with attributes of the union are addressed, namely: publicity, continuity, stability, and, finally, the intention of conceiving a family. Having done this, the similarities between a stable union and a qualified relationship and their differences are discussed. Finally, the dating contract itself is analyzed, presenting the doctrinal currents that defend it and those that are in favor of its nullity.
