DIGITAL LAW AND THE ATTEMPT TO REGULATE VIRTUAL REALITY

ABSTRACT

The present work aims to investigate Digital Law and its application in the regulation of virtual reality, analyzing the existing challenges and gaps and proposing guidelines for effective regulation. To this end, a literature review methodology was used, analyzing sources such as scientific articles, dissertations, theses and academic works related to the regulation of virtual reality. The bibliographical research is qualitative, focusing on understanding the topic. The objectives are descriptive, seeking to explain the relationships and influences in specific specificities. The sample covers materials published between 2017 and 2022 in Portuguese and English, including relevant classifications and legislation. The selection is careful, considering the currentness and reliability of the sources, and the main arguments, theories and concepts are identified and recorded in detailed notes. In view of the above, it is concluded that the regulation of virtual reality in Brazil, within the context of digital law, represents a complex challenge, since this technology is constantly evolving and involves issues ranging from the protection of personal data to the definition of responsibilities in virtual environments. The search for a balance between promoting innovation and ensuring the rights of individuals makes it essential to regulate care that takes into account not only technical issues, but also the ethical and social implications of virtual reality. Debate and the creation of appropriate policies are crucial to ensure that virtual reality is a useful and safe tool for Brazilian citizens.
