ABSTRACT

This article aims to elucidate and analyze the applicability of the protective measures provided for in the Maria da Penha Law, whether in society or in the legal system, it also aims to analyze the effectiveness of the law in the face of the numbers of violence in Brazil, as well as the growing rate of gender violence that plagues the country. Initially, a brief history of how the law originated and some of the constitutional principles applicable to cases of violence will be presented, seeking to study women and violence in a sociological context. Aiming to identify if there really is an effectiveness against domestic violence in Law nº 11.340/06, as well as to address the emblematic case of Maria da Penha and finally, the procedures of the measures to be carried out to the victim. The article also deepens on protective measures, aiming to present the conceptualization and application. The methodology took place, mainly, in the bibliographical research, developed from the consultation of the most varied titles in the area of legal, psychological and sociological sciences, legal texts, quantitative data and analysis of real situations.
