The Human Right of Access to Justice: A Historical and Bibliographic Review

Abstract: This article investigates the historical evolution of the treatment given to the right of access to justice over time, including its recognition as a human right. It also identifies and analyzes how access to justice is currently addressed in Brazilian legal doctrine as a human right, including its content and scope, which guarantees the realization of other citizens' rights. The methodology employed was bibliographic research, using descriptive and explanatory techniques, based on existing scientific articles and books on the subject. The conclusion reached was that the human right of access to justice has a much broader content than the formal guarantee of access to courts by the population. It includes the material possibility of accessing courts, obtaining a fair and speedy judgment, and obtaining necessary information and advice.
