ABSTRACT

The proposed theme of this paper is the inefficiency of the application of custodial sentences in Brazil associated with the prison system crisis. This article aims to briefly analyze the effectiveness of custodial sentences in order to observe if they contribute to the much-discussed prison crisis in recent times. Therefore, it is necessary to provide brief accounts of the origin and evolution of punishment, and then delve into the penitentiary systems to determine which system is adopted by our legal framework. Finally, a discussion on the current situation of the Brazilian prison system and the factors that interfere with prisoner rehabilitation is necessary, including an analysis of one of these factors: the inefficiency of applying custodial sentences. A bibliographic research was conducted, considering books by various authors and scientific articles published on the internet, which sought to bring discussions on the topic.
