ABSTRACT:
Law 14,340/2022 brought significant changes to family law and the protection of parental relationships in Brazil, by modifying procedures related to parental alienation. Parental alienation involves the negative influence of one parent on the child, causing them to be estranged from the other parent. This undergraduate thesis examines the changes introduced by Law No. 14,340/2022, provides context, explores legal implications, and their impact on family relationships and children’s rights. It takes the perspective that before the new law, the procedures for addressing parental alienation were considered inadequate, resulting in complex disputes and harming children. For this reason, it analyzes the legal implications of these modifications and their impact on the parties involved, including children, parents, and the judicial system, with practical cases and jurisprudence that exemplify the law’s application.
