THE VALUATION OF EVIDENCE IN THE POLICE INQUIRY: THE (IM)POSSIBILITY OF USING THE EVIDENCE FROM THE INQUIRY IN THE JUDGE'S RULING

ABSTRACT

The present work aims to study the evaluation of evidence produced during the police investigation and its implications for the foundation of judicial decisions. The police investigation, as a preliminary investigative phase of the criminal process, is essential for constructing a solid evidentiary set. However, often the evidence generated during this phase is obtained in an inquisitorial manner, without full observance of the principles of contradiction and broad defense, which raises doubts about its admissibility in the criminal process. Given this scenario, the research proposes to analyze the valuation of evidence produced in the police investigation and identify the limits of its use in the foundation of the judge’s decision. The study is justified by the need to establish clear and objective criteria for evaluating this evidence, thus preserving the fundamental rights and guarantees of individuals involved in the criminal process. It is expected that the results obtained will contribute to academic debate and the development of legal knowledge in the area, as well as serving as a reference for future investigations and the formulation of public policies aimed at improving the criminal justice system. The methodology adopted consists of a literature review, analyzing books, articles, dissertations, theses, and other materials relevant to the theme.
